Social Media Community Guidelines
(the “Guidelines”)
CarMax Enterprise Services, LLC and its affiliates, excluding Edmunds.com, Inc. (“CarMax,” “us,” or “we”) manage multiple social media accounts, including Facebook, Instagram, and TikTok, among others (collectively, the “Social Media Accounts” or “Social Media Channels”) to inform and connect our customers and community. We are proud to offer a space where users can follow, learn, and share – respectfully. To maintain this open community, CarMax and its Social Media Channels adhere to the guidelines below.
By following, using, or accessing CarMax’s Social Media Accounts, you agree to comply with these Guidelines, and each social media platform’s terms and conditions of use. These Guidelines supplement CarMax’s Terms of Use and in any instance where the Terms of Use and these Guidelines directly conflict, CarMax’s Terms of Use will control.
We reserve the right to remove or hide any post or comment, or block a user, that violates these Guidelines.
User Guidelines
1. Respect
We are building a community, together. Please respect the thoughts, opinions, and individuality of others – use common sense and decency and refrain from personal attacks, disrespectful language, posting material that isn’t appropriate for all users, or bullying in any form.
To maintain a respectful community, the following content is prohibited:
- Offensive language, including profanity, obscenities, derogatory content, or degrading comments about gender, race, religion, sexual orientation, or any other protected class;
- Libel, slander, defamation of character or other threats;
- Political or inciting statements;
- Any content that shows or encourages self-harm, animal cruelty, or unsafe behavior;
- Indecent, sexually explicit, or otherwise obscene material, or any material that is inappropriate for minors;
- Content that may constitute harassment or inappropriate, predatory, or unlawful material;
- Promotion or depiction of illegal activities or unsafe use of CarMax property or products, including unsafe driving;
- Use of a third-party’s protected intellectual property without the appropriate rights or permissions to use.
2. Privacy
To respect the safety and privacy of others, you agree not to:
- Impersonate, imitate, or pretend to be someone else, by setting up different accounts or otherwise, or falsely state, represent, or imply any affiliation, association, or connection with a person or entity;
- Post comments that violate the privacy of our associates or others (e.g., listing personally identifiable information, such as a first and last name, telephone number, address, etc.);
- Post manipulated or false images; or
- Disclose any personal account information.
3. No Spam
We strive to support a meaningful conversation. Any intrusive or repetitive comments that are off-topic or do not meaningfully contribute to the conversation may be deleted or suppressed.
Additionally, we prohibit any content or comments that:
- Promote any scam or illegal activity;
- Include any solicitation, advertisement, or promotion of personal commercial activity;
- Include information that is false, inaccurate or misleading;
- Include links, files, gifs, software, or programs that are intrusive or may carry any viruses, contain corrupted files, or damage any user’s computer;
- Are generated by a bot or include an intrusive gif, image or link that may encourage a bot.
We welcome the honest thoughts and opinions of our customers, and we are committed to responding to concerns. Please keep in mind, however, that a repetitive comment after CarMax has requested or provided follow-up through a direct communication channel (e.g., direct message or phone) may be subject to deletion. You may always contact us via the Contact Us page on our site.
4. Third Parties & Other Rules
Please remember that each social media platform has their own terms and conditions and content guidelines. Each user is responsible for what they post and for abiding by all applicable laws, rules, regulations, and third-party terms, conditions, and guidelines.
If you do not comply, content may be removed, or the third-party site or social media platform may take action in their sole discretion. CarMax is not responsible for such third-party platforms or sites, nor are we responsible for their privacy and data security policies and procedures. 5. Monitoring & More Information
Please keep in mind:
- We are committed to monitoring and responding to your comments. We may use third-party monitoring services to help us enforce these guidelines and offer timely responses.
- You must be 13+ years old to participate. If you are a minor (that is older than 13), please do not post unless you have the permission of a parent or legal guardian.
- The opinions, statements, and claims posted on our Social Media Channels by others do not necessarily reflect the views of CarMax and are the responsibility of the applicable user.
6. CarMax Right to Use
As further outlined in our Terms of Use, by submitting any reviews, comments, other communications, videos, photos, or other content via the Social Media Channels (“User Materials”), you grant to CarMax a royalty-free, perpetual, irrevocable, worldwide, unlimited, nonexclusive license to use, reproduce, create derivative works from, modify, edit, translate, distribute, publish, perform, sublicense, distribute, sell, and display, in public or otherwise, any User Materials you make available, in any media or medium, in any form, format, or forum, and for any purpose, without consent from or compensation to you. You also grant to CarMax:
- A nonexclusive, worldwide, royalty-free license to use all trademarks, trade names, and the names and likenesses of any individuals that appear in User Materials; and
- The right to include the name or other identifying label (e.g., handle) you provide or use with the User Materials, with the understanding that CarMax is under no obligation to attribute User Materials to you.
Please do not send any User Materials to us that you do not wish to license to us, including any confidential information.
By participating on a Social Media Account, you waive any “moral rights” or other rights with respect to authorship or attribution and you agree you will indemnify CarMax for all claims relating to any User Materials you supply. CarMax takes no responsibility and assumes no liability for any User Materials posted by you or a third party.
